Welcome to WEALTH365 ("the App"), operated by Pure Abundance LLC ("Company," "we," "us," or "our"). By accessing or using the App at wealth365.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
1. Description of Service
WEALTH365 is an AI-powered platform designed for entrepreneurs. The App provides tools including but not limited to: AI image generation, AI voice generation, AI video generation, content creation, sales coaching, journaling, and personalized brand development. The App uses third-party AI services to deliver these features.
2. Eligibility
You must be at least 18 years of age to use this App. By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
3. Account Registration
You must create an account to access the App. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
4. Subscription, Payment, and Refund Policy
WEALTH365 offers a 7-day trial for $7.00 USD with no automatic renewal. After the trial period, continued access requires a paid subscription at $222.00 USD per month. You may cancel your subscription at any time through the App or by contacting support. Cancellation takes effect at the end of your current billing period, and you will retain access until that date.
Because WEALTH365 is a digital software product that provides immediate access to AI-powered tools, content generation services, and proprietary methodology upon purchase, all sales are final and no refunds will be issued. By subscribing, you acknowledge that you are purchasing access to a digital service and that refunds are not available. If you are unsatisfied, you may cancel your subscription at any time to prevent future charges.
All payments are processed through Stripe. We do not store your payment card information on our servers.
5. User Content and Photos
You retain ownership of all content you upload to the App, including photos, text, and audio recordings ("User Content"). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and transmit your User Content solely for the purpose of providing the App's services to you.
When you upload photos for AI clone creation, you confirm that: (a) the photos are of you or you have explicit written permission from the person depicted; (b) you consent to these photos being processed by third-party AI services to generate your digital identity; (c) you understand that AI-generated images are approximations and may not be exact replicas of your appearance.
6. AI-Generated Content
The App generates content using artificial intelligence, including images, text, audio, and video. You acknowledge that: (a) AI-generated content may contain inaccuracies or imperfections; (b) AI-generated images of you are artistic renderings, not photographs; (c) you are solely responsible for reviewing and approving any AI-generated content before publishing or distributing it; (d) we do not guarantee that AI-generated content will be suitable for any particular purpose.
You own the AI-generated content created through your use of the App, subject to the underlying intellectual property rights of the AI models and third-party services used to generate such content.
7. Third-Party AI Services
The App integrates with third-party AI services to provide its features. These currently include but are not limited to: Higgsfield (image generation), fal.ai (image and video processing), HeyGen (video generation), ElevenLabs (voice generation), Fish Audio (voice generation), and Anthropic (text generation). By using the App, you acknowledge and agree that your data, including photos and voice recordings, may be transmitted to and processed by these third-party services in accordance with their respective terms of service and privacy policies.
We are not responsible for the actions, practices, or policies of these third-party services. We select reputable partners but cannot guarantee their ongoing availability, performance, or data handling practices.
8. Prohibited Conduct
You agree not to:
(a) Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, algorithms, prompts, methodologies, or trade secrets embedded in the App; (b) Use any automated means, including bots, scrapers, crawlers, or data mining tools, to access, collect, or extract data from the App; (c) Copy, reproduce, distribute, or create derivative works based on the App's proprietary content, methodology, or system prompts; (d) Attempt to access, probe, or test the vulnerability of the App's systems or breach any security or authentication measures; (e) Use the App to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable; (f) Upload photos of other individuals without their explicit consent; (g) Use AI-generated images to deceive, defraud, or misrepresent identity; (h) Share your account credentials with third parties or allow others to access your account; (i) Resell, sublicense, or commercially redistribute the App's services or output; (j) Interfere with or disrupt the App's operation or servers.
9. Intellectual Property
The App, including its design, features, proprietary methodologies (including but not limited to the SAFE Sales System, WEALTHYpreneur framework, Wealth Threshold concept, and all associated system prompts and AI instructions), is the exclusive property of Pure Abundance LLC and is protected by copyright, trademark, trade secret, and other intellectual property laws.
WEALTH365 and WEALTHYpreneur are trademarks of Pure Abundance LLC. You may not use these marks without our prior written consent.
The proprietary AI prompts, system instructions, methodology integrations, and content generation frameworks embedded in the App constitute trade secrets. Any unauthorized access to, reproduction of, or distribution of these trade secrets is strictly prohibited and may result in legal action.
10. Account Deletion and Data
You may delete your account at any time through the App's settings. Upon account deletion, we will: (a) remove your AI clone data from third-party services; (b) delete your personal data from our databases; (c) purge your uploaded photos and generated content from our storage. Some data may be retained as required by law or for legitimate business purposes (such as transaction records) for a limited period.
If your subscription is canceled, your account and associated data will be automatically deleted 30 days after cancellation.
11. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
The educational and coaching content provided through the App, including content related to heart science, nervous system regulation, and wealth mindset, is for informational and personal development purposes only. It is not medical advice, psychological treatment, or financial advice. Always consult qualified professionals for medical, psychological, or financial decisions.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PURE ABUNDANCE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OF OR INABILITY TO USE THE APP; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE APP; (D) ANY AI-GENERATED CONTENT.
Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless PURE ABUNDANCE LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any rights of a third party; (d) any User Content you upload or generate through the App.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Las Vegas, Nevada.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the App and updating the "Last Updated" date. Your continued use of the App after such changes constitutes acceptance of the revised Terms.
